Fishtown Medicine Terms of Use & Communication Consent

Understand your rights, privacy, billing, and how we deliver care. Includes communication, billing, and service policies.

These Terms of Use (“Terms”) describe your rights and responsibilities when you interact with or receive care from Fruition Medicine PLLC d/b/a Fishtown Medicine (“Fishtown,” “we,” “us,” “our”). By creating an account, scheduling or receiving services, or communicating with us in any way, you agree to these Terms and every policy referenced herein.

We work at the pace of your trust.


1 Eligibility & Licensure Scope

Our clinical services are available only to adults (18+) who are physically located in a U.S. state where our clinicians hold an active license at the time of the visit.


2 Consent to Treatment & Telehealth

2.1 General Consent
By using our services you authorize us to collect, use, and disclose your protected health information (“PHI”) for treatment, payment, and healthcare operations as permitted by HIPAA and applicable state law. Withdrawing consent ends our care relationship because PHI is essential to deliver and document medical services.

2.2 Telehealth Consent
Telehealth includes synchronous video, audio-only calls, asynchronous messaging, and remote monitoring.
• You understand potential benefits and risks (e.g., disrupted connectivity, unauthorized access).
• You may refuse or stop telehealth at any time without losing future benefits.
• If an in-person examination or procedure is medically necessary, we will refer you locally.


3 Communication Preferences & Consent

3.1 SMS Text Messaging
Opting-in allows us to send PHI-containing texts (frequency varies). Carrier message/data rates may apply; unencrypted SMS can be intercepted after delivery. Text STOP to opt out or HELP for assistance at any time. Promotional or educational texts always include opt-out instructions.

3.2 Phone Calls & Voicemail
You consent to care-related calls that may include PHI. Protect any voicemail that contains PHI.

3.3 Email & Secure Portal
Routine clinical messages are sent through our HIPAA-secure portal. If you choose ordinary email you accept its inherent privacy risks.


4 Recording of Calls & Video Sessions

For quality assurance, training, documentation, and fraud prevention we may record and securely store calls and video visits. Recordings are PHI and are released externally only with your written authorization or as required by law.

7 Emergencies & Service Limitations

We are not an emergency medical service.
• Call 911 or go to the nearest ER for any medical or mental-health emergency.
• For mental-health crises, call or text 988.
• Established patients typically receive same-day responses for urgent issues during business hours. Notify us after any ER visit so we can coordinate follow-up.
We may refer you to urgent-care centers or specialists for conditions requiring in-person procedures or outside primary-care scope.


8 Financial & Subscription Terms

8.1 Payment Processing via Stripe
All payments are processed by Stripe Inc.; we never store your card or bank details.

8.2 Subscription Billing
Membership fees recur at the interval shown at checkout and renew automatically until canceled. Card descriptors may appear as “FISHTOWN MEDICINE” or “FISHTOWNMD.”

8.3 Authorization to Charge
You certify that you are the authorized user of the payment method provided and permit Stripe/Fishtown to charge it for recurring fees, one-time services, add-ons, and non-refundable Stripe processing fees.

8.4 Cancellation & Proration

  • Quarterly & Annual memberships — Cancel any time. Unused months are refunded at the equivalent monthly rate minus Stripe fees, to the original payment method.

  • Monthly memberships — Cancel any time before renewal; no proration or refund once a new month begins.

  • If we end the relationship for reasons not listed in § 18, any prepaid unused portion is refunded on the same prorated basis minus Stripe fees.

8.5 30-Day Refund Guarantee
You may request a full refund of any charge within 30 days for any reason; Stripe fees are deducted. Email [email protected] with the charge date and last four digits of the card. Approved refunds post within 7-10 business days.

8.6 Failed Payments & Chargebacks
Stripe may automatically retry failed transactions. If a charge still fails, we’ll ask you to update your method; services may pause until the account is current. Contact us first to resolve disputes—initiating a chargeback beforehand may temporarily suspend access.

8.7 Fee-Change Notice
We provide three (3) months’ advance email notice before any membership price increase. You may cancel before the new rate takes effect.

8.8 Good-Faith Estimate (No Surprises Act)
Although our pricing is subscription-based and fully disclosed at enrollment, uninsured or self-pay patients may request a Good-Faith Estimate of expected charges at any time by emailing [email protected].


9 Patient Responsibilities

Provide complete and accurate health information, keep contact and payment details current, follow agreed care plans, and seek emergency help when advised.


10 Technology Requirements & Security

You must maintain reliable internet/cellular service and current OS/browser and keep your own devices, passwords, and portal credentials secure. We are not liable for breaches originating from insecure personal devices.


11 Third-Party Services & Disclaimers

We may refer you to independent labs, imaging centers, pharmacies, EHR, communication, or other vendors. Each operates under its own terms and privacy policy. We maintain a signed Business Associate Agreement (BAA) with every HIPAA-covered vendor.

11A Cookie & Tracking-Pixel Disclosure

Our site uses Google Analytics/Tag Manager and Meta Pixel. These place cookies that collect device and usage data. By using the site you consent to such tracking. See our Cookie Policy for opt-out instructions.

11B Language & Accessibility

We provide care most efficiently in English but no-cost professional interpretation services are available on request, and we will make reasonable accommodations for patients with disabilities. Email [email protected] for assistance.


12 Product Recommendations, Free Samples & Fullscript Commission

While we sometimes receive complimentary samples or incentives, our recommendations are guided solely by what we believe best serves your health.

  1. Free Samples — Passed to patients without markup; acceptance is optional.

  2. Fullscript Affiliate Relationship — Purchases through our Fullscript dispensary pay Fishtown a modest commission that offsets platform costs and enables refill tracking, dose updates, and interaction alerts—added value at no extra cost to you. Pricing is comparable or more competitive than other sources. This relationship is disclosed here and, when practical, at point of recommendation (FTC 16 C.F.R. § 255).

  3. Other Sources — We routinely suggest non-commission options when they better serve you.

  4. Product Categories — Supplements, health tools, remote-monitoring devices.


13 Controlled-Substance Policy

  • We do not prescribe Schedule II opioids.

  • Benzodiazepines are prescribed only for very short courses at the lowest effective dose and under strict clinical criteria.

  • Stimulants (e.g., for ADHD) may be prescribed only after appropriate evaluation and PDMP query, documented in your chart.

14 Scope of Practice — Services We Do Not Provide

• Obstetric or pediatric care (< 18 yrs)
• Chronic opioid management
• Organ-transplant care or coordination
• Surgical care
• Disability or workers-comp determinations
When excluded services are needed, we provide appropriate referrals.


15 No-Insurance Billing Disclaimer

Fishtown Medicine is not an insurance plan. We do not bill or interact with Medicare, Medicaid, or private insurers on your behalf; membership fees are direct-pay and may not be reimbursable.


16 Data Retention & Destruction

We retain PHI for at least seven (7) years (longer if law requires) and then destroy it using HIPAA-compliant methods.


17 Children’s Privacy (< 16)

Our website, portal, and services are not directed to individuals under 16. If you believe a minor has provided us PHI, email [email protected] so we can delete it.


18 Right to Decline Care / Patient Termination

We may terminate care with 30-day written notice for disruptive behavior, non-payment, or repeated non-adherence. We do not provide emergency care; call 911 or go to an ER when indicated. Referral information is provided during the notice period.


19 Indemnification

You agree to indemnify and hold Fishtown, its clinicians, officers, and employees harmless from any claim, damage, or expense arising from your breach of these Terms, misuse of the Services, or violation of law or another’s rights.


20 Force Majeure

Neither party is liable for failure to perform obligations due to causes beyond reasonable control, including natural disasters, acts of terrorism, pandemics, labor disputes, or widespread network outages.


21 Feedback License

Any suggestions, testimonials, or feedback you provide may be used to improve our services without compensation. PHI will never be publicly attributed without your written permission.


22 Intellectual Property

All site and service content is owned by or licensed to Fishtown. You may use it only for personal, non-commercial purposes related to receiving care.


23 Disclaimers & Limitation of Liability

Services are provided “as-is” and “as-available.” Except as required by law, we disclaim all warranties. To the fullest extent permitted, our total liability for any claim is limited to the amount you paid for the service giving rise to the claim.


24 Severability & Waiver

If any provision of these Terms is found unenforceable, the remainder remains in full force. Our failure to enforce any right is not a waiver of that right.


25 Changes to These Terms

We may update these Terms to reflect legal, technological, or operational changes. Revised Terms take effect when posted. Material changes are announced via portal message or the email on file. Continued use after the effective date constitutes acceptance.


26 Governing Law & Dispute Resolution

These Terms are governed by Pennsylvania law (unless federal law applies). Disputes are resolved by binding arbitration in Philadelphia, PA under American Arbitration Association rules, unless prohibited by law.


27 HIPAA Breach Notification & Security Program

In the event of a breach of unsecured PHI we notify affected patients within 60 days of discovery (45 CFR § 164.404). We maintain:
• An annual HIPAA Security Risk Analysis with mitigation steps.
• A signed BAA ledger for every HIPAA-covered vendor.
• Vendor attestations that encrypted off-site backups capable of timely restoration are in place; we verify this during vendor due-diligence reviews.


28 AI-Generated & Automated Content Disclosure

We employ AI tools to draft educational content and automate routine reminders. A licensed clinician reviews all patient-specific communications and clinical decisions before release.
